FBI: Violent crime rates in US approach historic lows

Violent crime rates in the U.S. are reaching historic lows, according to new FBI data released Monday.

Instances of murder declined overall by 1.9 percent from 2010 figures, while rape, robbery and aggravated assault declined by 4 percent nationwide, according to records from more than 14,000 law-enforcement agencies around the country, FBI spokesman Bill Carter told msnbc.com.


The number of property crimes also registered a 0.8-percent drop, motor-vehicle thefts declined by 3.3 percent, and arson was down by 5 percent.

Although the findings, released in the FBI?s Preliminary Annual Uniform Crime Report, represent a seemingly small decline in crime overall, they aren?t just a blip. Rather, criminologists say, the decline is part of larger downward trend and the result of a series of changes that have contributed to a more peaceful society.

?This is actually a pretty significant drop, which is fascinating because we?d normally expect crime to go up when we?re in an economic downturn,? Gary LaFree, a criminology professor at the University of Maryland, told msnbc.com, adding that the U.S. is experiencing the lowest crime levels since World War II.

According to FBI analysis, the homicide drop would mean that nearly 280 fewer Americans were murdered last year, which would be the lowest homicide death toll since the mid-1950s.

LaFree said a combination of factors ? from a weak economy and an aging population to increased immigration and a more robust police presence across the country ? have contributed to the drop.

?One of the responses of society is to pull together when there?s a huge crisis and a feeling of great difficulty,? LaFree said, adding that the economic climate may have contributed to this peaceful trend.

Additionally, with the current U.S. median age at 37.2 years, older than ever before, the aging population is another possible cause, LaFree said. ?There is some truth to the fact that younger people commit more crimes,? he said.

?We also have a record number of immigrants, and contrary to popular belief,? LaFree said, ?immigrants have lower crime rates than the rest of society.?

But some argue the data may not signify such remarkable changes.

?Year-to-year changes are notoriously volatile, especially for lesser-volume crimes like murder,? James Alan Fox, a criminologist at Northeastern University in Boston, wrote in his blog. ?They must be viewed with caution, avoiding the temptation to make too much out of rather little.?

Fox said it?s possible the long-term downturn in crime has slowed and even bottomed out.

Still, LaFree argued there?s a reason the numbers indicate what they do.

?Compared to years ago, ?There?s nothing that?s ripping apart the fabric of society in a political sense,? LaFree said.

The mass protests during the Vietnam War and the beginnings of crack cocaine epidemic contributed to more violent crimes in the past, LaFree said. He said he thinks there are fewer problems as extreme as either of those in society today. ?

As for the serious crimes that do occur, there exists a strong deterrence factor in the prison system, despite debates about its effectiveness, he said.

But more importantly, LaFree said, there has been a ?quiet revolution? in law-enforcement policy over the past few years.

?Police departments have become much more proactive across the country,? Lafree said. ?They used to deploy resources to handle crime, but now they?re much more likely to target problems beforehand and emphasize a solution.?

Fox, however, warned against resting on news that could be seen as too positive.

?With rates relatively low, this is not the time to diminish crime fighting-efforts,? he said. ?If we naively presume that the crime problem has been solved (as opposed to just controlled for the time being), the crime rate could easily rebound.?

The FBI's final crime figures will be released this fall.

OGDEN, Utah ? Trial has begun over whether to make Ogden?s highly controversial use of restraining orders against members of one street gang permanent.

Attorneys for some of the alleged gang members have fought it, claiming it violates their First Amendment right of free association. Lawyers for Ogden police and Weber County argue that it?s an effective way to cut down on crime.

?Graffiti?s down 50 percent in the city,? Weber County Attorney Dee Smith told FOX 13. ?Other crimes are down anywhere from 10 to 40 percent.?

The restraining orders have been served on hundreds of members of the gang, prohibiting them from associating with each other in public within Ogden city limits. It also limits their abilities to carry guns or graffiti tools.

?It stops them from seeing certain people in any places in any circumstances,? said Randy Richards, an attorney for some of the alleged gang members. ?It prevents them from going out after certain period of time. It prevents them from engaging in a number of different legal activities, normally legal ? but now illegal for them.?

On Monday, Second District Judge Ernie Jones heard testimony from police officers who have dealt with the gang. Inmates who are members of the gang were also brought up from the Utah State Prison to testify about their tattoos and identify themselves in photographs.

Lawyers for the alleged gang members tried to warn them that their words may come back to haunt them in future criminal prosecutions. It was revealed in court that federal prosecutors had been looking at the gang for a potential RICO (racketeering) case. However, nothing had come of it.

Brent Vigil smiled and laughed at some of the pictures, but when asked about what his tattoos said, he turned serious and replied: ?It?s just a gang-related tattoo.?

Elmer Maes Jr. was declared a ?hostile witness? for refusing to answer some questions in the civil trial.

?I got my injunction paper!? he barked at Smith while on the witness stand. ?I been served! What?s the point of this? If I don?t have a say, then I don?t want to say.?

FOX 13 was there when police served the restraining orders back in 2010. Police went door-to-door, tracking down people they said were documented gang members and served them with the papers.

None of the alleged gang members served with restraining orders showed up to court on Monday. Their lawyers claimed that if they did, they would be in violation of the injunction.

?It?s clearly unconstitutional,? argued attorney Michael Studebaker.

A woman named Mia, who refused to give her last name and asked that her face not be shown on TV, told FOX 13 her husband was served an injunction after doing prison time for gang crimes. She said the restraining orders go too far, preventing members of the same family from seeing each other ? even after they have paid their debt to society.

?We raise our family. We pay our house taxes. We own our vehicles. We own our home. We were born and raised here,? said Mia. ?What are we supposed to do? Sell our home and leave just because the gang unit feels like they want to harass people??

The trial resumes on Tuesday. The judge could decide the case by Thursday. The legal impact of the restraining orders is being watched closely by other police agencies in Utah.

Smith told FOX 13 he would not rule out serving other gangs in the Ogden area with similar injunctions, if this is upheld by the courts.

?Once this one?s complete, then we?ll make decisions after that about who?s next,? he said.

France headed toward undivided leftist government

Leftist parties performed strongly in Round 1 of France's parliamentary elections yesterday, setting up?President Fran?ois Hollande to have wide latitude in governing.

President Fran?ois Hollande and the French left took Round 1 yesterday of parliamentary elections that are being closely watched as harbingers of Europe?s political direction at a time of economic crisis.

Most of the individual seats still need to be won in a June 17 runoff. But leftist parties enter those contests with the overall best showing, taking 46 percent of French voters, and setting up Mr. Hollande and his Socialists???who won 36 percent ??for a majority needed for a free hand and an undivided government.?

?It?s a very, very good result for the Socialists and Fran?ois Hollande,? says Arun Kapil of Catholic University in Paris. ?But we will see on June 17. I think the Socialists are on track to get a majority on their own.?

Six of Hollande?s 24 declared cabinet ministers, including Prime Minister Jean-Marc Ayrault and Foreign Minister Laurent Fabius, were elected outright yesterday. But as of this morning?s tally, only about 60 seats of the 577-seat body were decided after the lowest voter turnout (57 percent) since Charles de Gaulle took office in the 1960s.

Under the election rules, a candidate must receive an outright majority of votes to win in Round 1. Otherwise, all candidates who garner more than 12.5 percent of the vote advance to a runoff.

Winning a clear majority on June 17 would enable Hollande to consolidate power and give heft to programs expected to combine growth with the tough and increasingly controversial austerity-only policies that have dominated Europe?s remedy for its economic crisis and that are favored by German Chancellor Angela Merkel.

While characterized by some foreign media as a ?tax and spend? liberal, Hollande is in fact?a pragmatist who pledges a balanced budget by 2017 and a 3 percent budget deficit next year. The French right is skeptical he can do so.

Like most European politicians in an age of austerity, Hollande's hand is severely constrained. So far, he has implemented symbolic measures such as cutting his and his ministers' salaries by 30 percent. He has tinkered with social fairness policies: He did not change the pension reforms of Mr. Sarkozy that moved France's generous retirement age from 60 to 62; but he added a caveat allowing those beginning work at age 18 to retire at 60, and to allow females to count part of their pregnancy months.?

But while French voters gave Hollande a boost, he has not yet delivered a knockout blow to the political right.? The main right party of former president Nicolas Sarkozy took 27 percent to bring the conservative majority to a 34 percent total.

?There was no ?pink landslide,?? said former Prime Minister Fran?ois Fillon, referring to the vote on the left.

?Without a majority, no laws will be passed,? warned Prime Minister Ayrault after last night?s tally.

The elections appear set to give the French far right party of Marine Le Pen, which is anti-Europe and anti-Islam, its first seats in decades. Ms. Le Pen?s National Front, which is now the No. 3 party in France, got 13.6 percent. ?But in a clear blow to Le Pen, the main French right party headed until May by Nicolas Sarkozy has not been willing to align itself with her, dashing her hopes for a historic realignment.

However, Le Pen trounced far-left figure Jean-Luc M?lenchon in Henin-Beaumont, a distressed former mining region, in what Mr. Melenchon had hoped would be a comeuppance for her. Melenchon had made waves this spring as a dynamic new voice on the far nationalist left. But after carpetbagging up in the French north, his nose was bloodied by Le Pen, who scored 42 percent to his 21 percent.

Le Pen?s party may score three seats. In Paris today, speculation has it that one of those seats would be from the Le Pen clan: Marion Marechal-Le Pen, Ms. Le Pen?s niece and granddaughter of Jean-Marie Le Pen, the party founder.

In an unexpected development, S?gol?ne Royal, the Socialist Party nominee in 2007 and the former partner of Hollande, could well lose her seat after deciding to run in a region that has other popular long-time Socialists. Le Parisian today commented on a campaign of ?Saving Private Royal,? after party officials have tried to ban other candidates from that seat.

Obama doesn't emphasize issues he fought hard for

PHILADELPHIA (AP) ? Fighting for re-election, President Barack Obama is playing down his historic health care overhaul and the multibillion-dollar recession-fighting stimulus ? two landmark efforts of his first three years in office. Those signature policies are unpopular, and voters clearly want the candidates to focus instead on jobs.

Dealing with a slow-moving economy, Obama is imploring voters to stick with him through tough times while promising that better days lie ahead ? with him, not Republican foe Mitt Romney. The selling of Obama's first term, however, isn't so simple.

The president can't tell voters about a grand economic comeback story because there isn't one to tell. In foreign affairs, he can't declare outright victory in Iraq and Afghanistan so he promotes the ending of a "decade under the dark cloud of war." Health care reform, his most prominent legislative achievement, is unpopular with many voters and could be struck down by the Supreme Court this month.

Obama's re-election slogan ? "Forward" ? aims to fit the times, offering a sober assessment of a nation trying to turn the page from war and economic turmoil under his watch while implying that Republican Romney would take the country backward.

The president offers a steady drumbeat about a "make-or-break moment" for the middle class and creating a country "where everybody gets a fair shot and everybody is doing their fair share."

Speaking at a fundraiser in Philadelphia's Franklin Institute, Obama said Republicans have a dearth of ideas and will offer the same economic prescriptions that preceded the most recent recession.

"It will be the same stuff, the same okey doke," he said.

He added that Americans are resilient and that the country will recover.

"It turns out Americans are tougher than any tough times," he said. "All across the country, people made tough decisions but they were determined to move forward because Americans, we don't quit."

Romney says the problem isn't with the American people, it's with Obama. He calls the president's policies "muddled, confused and simply ineffective."

"The American people are having such a hard time. That's why the idea of selecting as a campaign slogan 'Forward' is so absurd," Romney said Tuesday on Fox News' "Fox and Friends." ''People are having hard times in this country, and the president needs to go out and talk to people. Not just do fundraisers."

Both Romney and Obama do plenty of fundraisings, building for the summer and fall campaign.

Obama was headlining six fundraisers Tuesday in Maryland and Pennsylvania, where he was expected to raise at least $3.6 million. The president told supporters in Maryland that the GOP is simply blaming him for the country's woes.

"You can pretty much put their campaign on a tweet and have some characters to spare," he said of the social networking site's 140-character limit.

Democrats both inside and out of the campaign say their best bet is to run a "choice" election against Romney and try to meld the former Massachusetts governor with an unpopular Congress, all the while maintaining a focus on pocketbook issues important to the middle class.

Obama's advertising has given an overview of his first term, focusing on the rescue of the auto industry, the death of Osama bin Laden and the return of many of America's troops from overseas. He has aired separate ads on his administration's attention to veterans and efforts to crack down on Medicare fraud on behalf of seniors.

But many of the major pieces of Obama's first-term record get scant attention in ads, reflecting mixed reviews from the public after Republicans pinned the labels "job-killing" and "big government" on the health care plan and said the stimulus spending increased the federal deficit.

On health care, a recent CBS-New York Times poll found that 41 percent of Americans think the Supreme Court should overturn the entire 2010 overhaul. Some 27 percent think the justices should remove the individual mandate that requires individuals to have health insurance and fine them if they don't, and 24 percent think the law should remain in place.

The public has remained divided over Obama's $830 billion stimulus bill, even as the administration has said it accounted for millions of jobs.

An ABC News/Washington Post poll in May found that 47 percent approve of the stimulus legislation and 48 percent disapprove while 5 percent had no opinion. The poll found that 50 percent favored the Obama administration's increased regulations of financial institutions while 44 percent viewed them unfavorably.

Obama's quest for a second term is punctuated with images of a resilient America. His television ads show U.S. auto workers whose jobs are said to have been saved by the bailing out of General Motors and Chrysler. There also are children jumping into the arms of soldiers who made it home from war, and night-vision shots of the servicemen who killed bin Laden.

At the same time, Obama's campaign tries to discredit Romney's claim to be an economic maestro, casting him as a political version of the movies' Gordon Gekko. Out-of-work steel workers liken Romney's former private equity firm, Bain Capital, to blood-sucking vampires. Another ad tells of a Massachusetts under Governor Romney that saw tepid job growth, more debt and the outsourcing of jobs to India, the cold-hearted decisions of an uncaring corporate culture.

On his own record, Obama does talk up what he says are the benefits of the sweeping health care bill on occasion, particularly to donors, telling them it allowed millions of young people to be on their parents' insurance and millions of seniors to have lower prescription drug costs.

On the recession-fighting spending, the president rarely uses the term "stimulus," instead referring to the nation's economic system being built on a "house of cards" that collapsed in 2008 and forced his administration to take bold steps.

A seven-minute Web video produced by his campaign, entitled "Forward," says the economic stimulus "saved up to 4.2 million jobs" and says Obama "took on the Wall Street banks" to push reforms to ensure that bankers "never again wreck our economy."

The video also mentions Obama's work to pass "historic health reform" that bars insurance companies from denying coverage for children with pre-existing conditions, helps seniors pay less for prescriptions and provides contraception coverage.

"And by 2016, 32 million more Americans will have health coverage," the video says, neglecting to mention the role the Supreme Court could play in the law's future.

But the health overhaul isn't the campaign's focus.

"This has to be all about the middle class and the economy," said Paul Begala, a Democratic strategist and adviser to Priorities USA Action, a Democratic super PAC.

That still leaves plenty of uncertainties. If the European debt crisis craters and the trajectory of the economy heads in the wrong direction during the summer, all bets could be off.

"There's nothing we can do about the economy," said Dick Harpootlian, a Columbia, S.C., attorney and chairman of the state's Democratic Party. "(German) Chancellor (Angela) Merkel has more to do with that piece of the campaign than anybody else."

Flame pieces found in Stuxnet virus: expert

A leading computer security firm has linked some of the software code in the powerful Flame virus to the Stuxnet cyber weapon, which reportedly was used by the United States and Israel to attack Iran's nuclear program.

Eugene Kaspersky, chief executive of Moscow-based Kaspersky Lab, which uncovered Flame last month, said at the Reuters Global Media and Technology Summit on Monday his researchers have since found that part of the Flame program code is nearly identical to code found in a 2009 version of Stuxnet.

The new research could bolster the belief of many security experts that Stuxnet was part of a massive U.S.-led cyber program still active in the Middle East and perhaps other parts of the world.

Although Kaspersky did not say who he thought built Flame, news organizations, including Reuters and The New York Times, have reported the U.S. and Israel were behind Stuxnet -- which was uncovered in 2010 after it damaged centrifuges used to enrich uranium at a facility in Natanz, Iran.

Instead of issuing denials, authorities in Washington recently launched investigations into leaks about the highly classified project.

On Stuxnet and Flame, "there were two different teams working in collaboration," Kaspersky told the Reuters Summit in London.

Flame is a highly sophisticated computer virus that disguises itself as common business software. It was deployed at least five years ago and can eavesdrop on conversations on the computers it infects and steal data.

Security experts have suspected a link between Flame, Stuxnet and Duqu -- another piece of malicious software that was discovered last year -- but Kaspersky Lab is the first to say it found hard evidence.

Other private security companies were also racing to uncover the secrets of Flame and will soon weigh in on Kaspersky Lab's latest findings.

If the U.S. is proven to be a force behind Flame, it would confirm the country that invented the Internet is involved in cyber espionage -- something for which it has criticized China, Russia and other nations.

A Pentagon report last year that outlined the still-evolving U.S. cyber strategy said economic espionage could prove the greatest threat to long-term U.S. interests, pointing to thefts of industrial and defense secrets via Internet spyware.

Similar traits
Kaspersky Lab had said Flame was developed with a different set of tools than Stuxnet, though it said its analysis was just beginning and would take many months.

After digging deeper, Kaspersky Lab said Monday its researchers identified segments of Flame and a version of Stuxnet released in 2009 that were nearly identical -- suggesting the engineers who built the two viruses had access to the same set of source code.

That suggested tight collaboration between the teams behind the two viruses. Eugene Kaspersky said it was clear there were two or more teams with differing styles, and that Flame as a whole might have employed 100 people.

Researchers have been looking for a connection between Stuxnet and Flame because both viruses infected machines by taking advantage of a Windows flaw to launch the "autorun" feature, and infected personal computers from a small drive inserted via USB slot.

The section of code now cited as connecting the two pieces of malicious software not only concerns that flaw but does so in the same style.

The Windows flaw was unknown before Stuxnet's discovery in 2010, according to Roel Schouwenberg, one of the Kaspersky Lab researchers who helped discover the Flame virus.

Kaspersky Lab researchers did not find the Flame components in more advanced versions of Stuxnet, added Schouwenberg.

"Flame was used as some sort of a kick-starter to get the Stuxnet project going," Schouwenberg theorized. "As soon as the Stuxnet team had their code ready, they went their way."

He suspected the creators of Stuxnet removed the borrowed components from later versions so the Flame program would not be compromised if the attack on the Iranian nuclear program was discovered.

Stuxnet was discovered in 2010 and has been closely scrutinized by the world's smartest cyber sleuths. Yet Flame remained hidden until last month, when a United Nations agency asked Kaspersky Lab to look for a virus that Iran said had sabotaged its computers, deleting valuable data.

When Kaspersky's team started looking for suspicious files in the Middle East, they found Flame.

Schouwenberg said he suspected Flame may be capable of deleting data and attacking industrial control systems that run plants like the uranium enrichment facility at Natanz, but he has yet to find the evidence to prove it.

Kaspersky Lab researchers are still trying to understand the function of more than 100 mysterious files built into the Flame samples that they have discovered, he said.

Analysts already widely regard Flame as one of the most sophisticated pieces of malicious software ever detected, along with Stuxnet and its data-stealing cousin, Duqu.
